3rd Time DUI

If you enter a plea or if you are found guilty of DUI for a third time, and the previous DUI conviction was more than 10 years before the current charge, there are enhanced penalties. The judge can sentence you to up to one year in the county jail! In addition to any jail time the judge may impose the following conditions are also mandatory:

  • 12 months probation
  • Advanced DUI School
  • Substance Abuse Treatment if recommended
  • A minimum 1 YEAR drivers license suspension
  • A minimum of $2000 fine (up to $5000)
  • Court Costs
  • A 30 day vehicle impoundment


A minimum 2 year ignition interlock for any car you drive including vehicles belonging to your family, friends or your work vehicle.
The court may also require a Victim Impact Panel

If your blow was .15 or higher the penalties are enhanced! In a case where the blow was .15 or higher, you can face up to one year in the county jail! In addition to jail, the court must impose:

  • 12 months probation
  • Advanced DUI School
  • Substance Abuse Treatment if recommended
  • A minimum 10 YEAR drivers license suspension
  • A minimum of $4000 fine
  • Court Costs
  • A 30 day vehicle impoundment


A minimum of 2 year ignition interlock for any car you drive including vehicles belonging to your family, friends or your work vehicle.
The court may also require you to attend the Victim Impact Panel.

If this is your 3rd DUI and the last conviction was less than 10 years ago, it is possible that the State can charge you with a felony. This means you can spend up to five years in the Florida Department of Corrections in addition to the mandatory probation terms. Whether it is charged as a felony or misdemeanor there is a minimum jail sentence of 30 days required by law.
