Trial

A trial is the formal hearing where witnesses are called against you and evidence is introduced. In a DUI case you are entitled to a trial by jury. This means six people, the jurors, will listen to the case and decide if you are innocent or guilty. These jurors are selected at the beginning of the trial from a larger group of potential jurors. This is referred to as “jury selection.” It is very important to hire an attorney who is skilled in jury selection. An experienced attorney will know the right questions to ask to get the best possible jurors for your case.

During the trial, your attorney will cross examine the witnesses and make the necessary objections. It is through the attorney that your side of the facts is presented. It is the attorney’s job to question what the officer and the evidence say and to present your defense for you. A good attorney will also discuss whether or not it is a good idea for you to testify. The more experience an attorney has, the better he or she is at presenting the case in a light most favorable to you.

If you are successful at trial you will be found not guilty. No sanctions will be imposed. If you are not successful you will proceed to sentencing. Having an attorney experienced with DUI trials is critical. The attorneys at Finebloom & Haenel have years of DUI trial experience. They investigate the officer’s background, habits and training in order to create a custom defense for you.
